課程概述 |
什麼是「異性戀霸權」(heterosexual hegemony),也就是Andrienne Rich所稱的「強迫異性戀」(compulsory heterosexuality)?強迫異性戀是對於典型異性戀圈外人,亦即所有非典型異性戀者(non-heterosexuals,包括同性戀、雙性戀…)的排除性歧視,或者是一套性別宰制的機制?法律如何製造/強化/再製強迫異性戀機制,同時又作為挑戰、拆解霸權的場域(contested site)?在不同的歷史階段中,強迫異性戀機制的形貌為何,法律又扮演了何種角色?
本學期的課程將以強迫異性戀機制為中心,以美國為空間,探究強迫異性戀機制在美國的歷史形貌與法律角色。在初步瞭解強迫異性戀的機制,思考歷史化的必要性與法律的角色之後,我們將閱讀兩個重要的文本:由女性主義法學和法律史學者Linda Hirshman和Jane Larson所共同撰寫的Hard Bargains: The Politics of Sex (NY: Oxford University Press, 1998),以及日裔美人男同志法學者Kenji Yoshino所發展出的「掩飾」(covering)理論,藉以由理論和歷史來思考強迫異性戀機制的傷害以及可能的出路。最後,我們將由兩個面向來思考歷史與2003年的重要里程碑判決Lawrence v. Texas的關係:歷史如何影響此判決?如何將此判決置於歷史的脈絡?

本課程非常重視同學們對每週閱讀材料的研讀理解思辯、上課的積極參與、以及報告的撰寫。課堂參與和讀書心得將佔學期成績的50%,期末報告占50%。 |
